DeSantis Pushes for Impeachment of Judge Who Released a Convicted Sex Offender Who Allegedly Went on to Kill a Child

Florida Gov. Ron DeSantis called Tuesday for the impeachment of a judge who allowed a convicted sex offender to roam free weeks before the death of a 5-year-old girl the man is accused of killing.

DeSantis issued the call while signing legislation known as Missy’s Law, which requires judges to revoke bond for those convicted of serious crimes, including sex offenses, according to WCTV-TV.

The law, which takes effect on July 1, was named for Missy Mogle, who was murdered in Tallahassee last year, the station reported.

Daniel Spencer, who was Missy’s stepfather, and Missy’s mother, Chloe Spencer, are both charged with murder, abuse and child neglect charges. The girl died by asphyxiation.

At the time of Missy’s death, Daniel Spencer had been found guilty on a charge of traveling to meet a minor for sexual purposes but was not behind bars because Leon Circuit Judge Tiffany Baker-Carper set him free pending sentencing.

At the bill signing, DeSantis said Missy’s death was “totally preventable, a miscarriage of justice, a dereliction of judicial duty.”

“This was an outrage,” DeSantis said, according to USA Today.

“This was such an easy call to make sure that this guy was put behind bars. And this judge refused to do it, knowing the risks, and the result has obviously been a tragedy,” he said.

DeSantis said the law was a major step forward.

“But I will just say to my friends in the Florida House of Representatives, I don’t think what you’ve done is enough. You have the power, and you have sufficient numbers in your chamber to impeach this judge, Tiffany Baker. Until you start holding these judges accountable, they are going to continue finding ways to benefit the criminal element,” he said.

Noting that it takes a two-thirds majority in the state House to impeach a judge, DeSantis said, “Last time I checked, we’ve got way more than two-thirds of Republicans. Honestly, I think some Democrats would vote to impeach given what’s happened in this case.”

Baker-Carper was elected in 2020 to a six-year term in November 2020. It wasn’t clear Tuesday whether she is running for re-election.

Pepper Mogle, Missy’s maternal grandmother, called the law DeSantis signed a positive development.

“I’m excited that they have passed the bill and that the governor is going to sign it,” she said before the bill signing. “We feel relieved and that the baby is getting justice.”

At the time of Daniel Spencer’s conviction, Baker-Carper rejected a prosecution request to lock up Spencer.

“He has been out for an entire year as far as I saw with no violations,” Baker-Carper said at the time, according to USA Today.

“I didn’t see any criminal history regarding violence. The only criminal history I saw was relating to drug offenses when I looked. Madam prosecutor, you’re free to enlighten the court if I’ve missed something,” she said then.
