An Ibiza-based tattoo artist has been found guilty of sexually assaulting a British tourist and jailed for five years.
Edgardo Jesus Milessi Oviedo learnt his fate just over two months after protesting his innocence at a one-day trial at a court in the Majorcan capital Palma.
His victim, 21, told the court the Argentinian who inked her during a holiday on the party island had ‘his tattoo gun in one hand’ and ‘the other on her genitals.’
State prosecutors had demanded the 50-year-old, bailed after the trial while he waited to learn his sentence, receive a six-year prison sentence if he was convicted of the June 15 2022 sex assault at a tattoo parlour in San Jose.
Prosecutors said in a two-page pre-trial indictment he targeted his alleged victim, 21 at the time, after she asked to have a butterfly tattoo done on her left hip.
They claimed he put his fingers inside her after she laid down on a stretcher in an assault they said lasted 25 minutes and caused her ‘great anguish and fear.’
The holidaymaker reported him to police in Scotland when she got back home, prompting his arrest on August 11 2022.
Court officials said today after a written sentence was issued following the November 4 trial: ‘The First Section of the Provincial Court of the Balearic Islands has sentenced E.J.M.O. to five years in prison for sexually abusing a client he was tattooing in Ibiza in June 2022.

The court has imposed a seven-year ban on him communicating with or going within 300 metres of the victim.
‘The court also ordered him to pay €15,000 (£13,000) in damages.
‘The judges considered it proven that on 15 June 2022, the victim who was on holiday in Ibiza, went with a friend to the defendant’s establishment to get a tattoo.
‘The two girls agreed to get the same design tattooed.
‘To get the tattoo, they had to go into a small room with a couch, while the other waited on a sofa in an adjoining room.
‘The victim was the second to get the tattoo.’
The judge stated in their sentence: ‘A few minutes after starting the tattoo, taking advantage of the victim’s position and the fact that she was not wearing knickers, the defendant while tattooing her, inserted his left fingers into her vagina without her consent and began to move them inside her, all this for approximately twenty-five uninterrupted minutes.
‘Their ruling says the victim suffered great distress and fear of the defendant and was “unable to react to what was happening, remaining paralysed, fearing that the defendant might do something worse if she moved.”‘
The judges went on to describe the British tourist’s evidence in their ruling as ‘coherent and persistent.’
Convicted sex offender Milessi, who had previous for a similar offence, has been told he can appeal.
It was not clear this afternoon whether he intended appealing but if he is does he is likely to be allowed to remain on bail until the appeal process is exhausted.
