The presiding judge in former FBI director James Comey’s bombshell case has been revealed as Judge Michael Nachmanoff, a former Biden appointee whose courtroom will now set the stage for one of the most politically charged trials in recent memory.
Comey was indicted on Thursday on charges of lying to Congress during his September 30, 2020, testimony on what was known as ‘Crossfire Hurricane’ by the FBI, the original probe into whether the Trump campaign colluded with Russia in 2016.
Nachmanoff, of the U.S. District Court for the Eastern District of Virginia, set Comey’s arraignment for October 9.
President Trump, speaking to reporters before leaving for the Ryder Cup with his granddaughter Kai, branded James Comey a ‘dirty cop’ and warned that more indictments could follow.
‘It is about justice. Not revenge. It is about justice,’ he said, adding, ‘They are sick, radical left people. And they can’t get away with it.’
US District Judge Michael Nachmanoff, a 2021 appointee of President Joe Biden, was randomly assigned to James Comey’s case.
Comey is scheduled to appear in Nachmanoff’s courtroom for his arraignment hearing on October 9.
Earlier this year, Nachmanoff let the CIA fire a doctor who pushed for mandatory COVID-19 vaccines for the military,’ Politico reported.
Before his 52-46 Senate confirmation, Nachmanoff served as a magistrate judge in the US District Court for the Eastern District of Virginia from 2015 to 2021.
During his time as a magistrate judge, he presided over the 2019 arraignment of two associates of Rudy Giuliani, Lev Parnas and Igor Fruman, who were charged with campaign finance violations. He released them on a $1 million bond.
Before that, he spent over a decade working in the federal public defender’s office.
He received his bachelor’s degree from Wesleyan University and his law degree from the University of Virginia.
What sentence does Comey face?
Former FBI director James Comey faces up to five years in prison if he is convicted of charges of lying to Congress.
He was indicted on Thursday on charges of making a false statement and obstruction relating to his oral testimony before the US Senate Judiciary Committee on September 30, 2020.
The US Attorney’s Office noted that actual sentences for federal crimes are typically less than the maximum penalties.
A federal district court judge will determine any sentence after considering the US Sentencing Guidelines and other statutory factors.

Interim U.S. Attorney Lindsey Halligan for the Eastern District of Virginia forged ahead with convening a grand jury against former FBI Director James Comey, despite having little to no support from Attorney General Pam Bondi’s team.
She was forced to argue the case alone to the grand jury, a person familiar with the matter confirmed.
The isolation was deliberate. An administration insider told the Daily Mail that Bondi wanted nothing to do with the Comey case – the DOJ didn’t believe Halligan could secure an indictment.
When proven wrong on Thursday, the source claimed the DOJ wanted to ‘come in as the hero.’
Former federal prosecutor Maurene Comey sued the Trump administration earlier this month to get her job back, saying her firing was for political reasons and was unconstitutional.
Comey was infamously fired in July without warning after she somehow bungled the case against Sean ‘Diddy’ Combs.
Her lawsuit in Manhattan federal court blamed the firing on the fact that her father is James Comey, the former FBI director who Trump fired in 2017, ‘or because of her perceived political affiliation and beliefs, or both.’

Who else is Trump targeting for criminal prosecution?
After James Comey was indicted on charges of lying to Congress, Donald Trump hinted that others could be next to face criminal prosecution.
Although he did not mention any specific names on Friday, the president noted, ‘It’s not a list, but I think there’ll be others.’
On Thursday, Trump directed his administration to crack down on backers of what it described as ‘left-wing terrorism.’
When pressed by a reporter to name any possible targets, he suggested two of the Democratic Party’s top donors – billionaires George Soros and Reid Hoffman.
‘Soros is a name certainly that I keep hearing. I don’t know,’ he said. ‘I hear names of some pretty rich people that are radical left people. Maybe I hear about a guy named Reid Hoffman, pretty rich guy I guess.’
Hoffman is a regular funder of progressive and mainstream Democratic causes, including writer E. Jean Carroll’s lawsuits against Trump that alleged he sexually assaulted and then defamed her.
Soros has long been a target of conservatives due to his progressive advocacy and funding of liberal causes.
When is Comey’s arraignment?
Former FBI director James Comey is scheduled to appear in court for his arraignment hearing on October 9 at 10am ET.
He will appear before Judge Michael Nachmanoff inside Alexandria Courtroom 600 at the US District Court in Virginia.

The Republican, 79, has refused to be cowed in the wake of the death of the political commentator, who was shot dead at 31 during a Q&A session at Utah Valley University, ramping up his public appearances instead of scaling them back.
James Comey and Donald Trump’s fraught history
James Comey was nominated as the FBI director in 2013 by Former President Barack Obama and remained in office when Donald Trump began his first term.
However, he was fired by Trump in 2017 amid an investigation into Russian election interference.
Justice Department special counsel Robert Mueller investigated the firing as a potential act of obstruction of justice.
After being let go, Comey authorized a close friend to share with a reporter the substance of an unclassified memo that documented an Oval Office request from Trump to shut down an FBI investigation into his first national security adviser, Michael Flynn.
Trump and his allies later branded Comey a leaker, with the president even accusing him of treason.
In 2018, Comey described Trump as a mafia don, unethical and ‘untethered to truth’ in his memoir.
The two have antagonized each other over the years, with Trump repeatedly claiming that Comey should face charges for ‘treason’ – an accusation Comey dismissed as ‘dumb lies’ – and calling him an ‘untruthful slime ball.’
Hakeem Jeffries slams Comey indictment as ‘disgraceful attack’
House Minority Leader Hakeem Jeffries called James Comey’s indictment ‘disgraceful’ and weaponization of the justice department.
‘The indictment of James Comey is a disgraceful attack on the rule of law. Donald Trump and his sycophants in the Department of Justice are completely and totally out of control, and have viciously weaponized the criminal justice system against their perceived adversaries,’ he said in a statement.
‘The malicious prosecution against James Comey has no apparent basis in law or fact, and lawyers of good conscience in the department know it. Anyone complicit in this malignant corruption will face accountability.’
Comey faced backlash over ‘8647’ post
On May 15, 2025, Comey posted a photo on Instagram showing seashells arranged to form the message, ‘8647.’ He captioned the image with: ‘Cool shell formation on my beach walk’.
It was deleted just hours later after Trump allies interpreted it as a code calling for the 47th president’s assassination. The service industry slang to ’86’ something is to get rid of it.
Comey insisted he was unaware of any political meaning and said he opposed violence.
But DHS Secretary Kristi Noem announced Secret Service launched an investigation and the former FBI Director voluntarily sat for an hour-long interview with the president’s protective detail.

What are the charges against James Comey?
Former FBI director James Comey was indicted on charges of making false statements and obstruction of justice on Thursday.
The charges for Comey were related to his testimony before the Senate Judiciary Committee on September 30, 2020 over Crossfire Hurricane – the codename for the Trump-Russia investigation.
In addition to the two charges, the grand jury declined to indict Comey on a third count, an additional charge of making false statements, court documents showed.
In September 2020, Comey was brought before Congress to discuss Crossfire Hurricane.
He is accused of having lied to the committee when asked whether he had authorized anyone else at the FBI to be an anonymous source of information related to investigations into either Trump or into Democratic nominee Hillary Clinton.
Comey’s son-in-law quits DOJ after indictment
James Comey’s son-in-law, Troy Edwards, resigned as a federal prosecutor just minutes after the former FBI boss was indicted.
Edwards quit his job ‘to uphold my oath to the Constitution and the country,’ he wrote in a one-sentence resignation letter addressed to Lindsey Halligan, the newly appointed acting US Attorney in Virginia’s Eastern District, whose office charged Comey.
Edwards was the deputy chief of the National Security Section, a prestigious role in a US attorney´s office that covers the Pentagon and CIA headquarters, handling some of the highest-profile espionage cases.
He was on the team of prosecutors who convicted Oath Keepers founder Stewart Rhodes of orchestrating a violent plot to storm the US Capitol on January 6, 2021, to keep President Donald Trump in the White House after he lost the 2020 election.

FBI Director Kash Patel denied that the investigation into James Comey was politically motivated.
‘Career FBI agents, intel analysts, and staff led the investigation into Comey and others. They called the balls and strikes and will continue to do so,’ he said on X.
‘The wildly false accusations attacking this FBI for the politicization of law enforcement comes from the same bankrupt media that sold the world on Russia Gate- it’s hypocrisy on steroids.
‘Their baseless objections tell us now, more than ever, that we are precisely over the target and will remain on mission until completion.’
Top Democrat Dick Durbin raged against the ‘politically corrupt’ indictment of former FBI Director James Comey.
‘The Department of Justice has become a political tool of a vengeful President,’ said the Senate Judiciary Committee ranking member.
Durbin added in a statement: ‘President Trump wears his corruption like a badge of honor and defies anyone daring to challenge him. The Attorney General willingly complies with every order from the White House.’
‘Is there one Republican left in Washington who gives a damn?’ he questioned.
Lindsey Halligan, 36, a former beauty queen, is an emerging MAGA star and was appointed US Attorney for the Eastern District of Virginia after her predecessor Erik Siebert was ousted last week.
She promptly filed charges against Comey as the prosecution’s case against Comey was nearing a statute of limitations that would have expired next Tuesday, according to The New York Times.
Halligan, whose parents worked in healthcare, went to a private Catholic school in Broomfield, Colorado, where she was a basketball and softball star.
She went on to study politics and broadcast journalism at Regis University, a Jesuit college in Denver, which was also attended by Erika Kirk, the widow of conservative activist Charlie Kirk, who was assassinated on September 10.
Halligan competed twice in Miss Colorado USA, making the semi-finals in 2009 and finishing fourth in 2010.
At the time, Trump co-owned the Miss Universe organization, which ran the pageants.
Later, she graduated from the University of Miami with a law degree and served in the city’s public defender’s office, before working on insurance cases as a partner in a private firm.
In late 2021 she went straight from a court case to an event at the Trump International Golf Club in West Palm Beach, Florida.

The TV host, a staunch critic of Donald Trump, said she sided with him because of how the former FBI boss had treated Hillary Clinton.
‘You know, I don’t like Comey. I agree with Trump on this one… I don’t like what he did to Hillary,’ Behar said on Thursday.
Behar was referencing Comey’s release of a letter on Clinton‘s use of a personal email server as Secretary of State right before the 2016 presidential elections. The scandal helped swing that year’s presidential election in Trump’s favor.

The president said Comey’s indictment was about ‘justice,’ describing the former FBI director as a ‘dirty cop.’

‘He is a dirty cop. He has always been a dirty cop,’ he said. ‘Everybody knew it.’
Trump said it was a ‘pretty easy case’ against Comey, pointing out that the former FBI director lied under oath.
‘He lied. He lied a lot but this was a very important thing. He could have said maybe or I don’t remember. He didn’t say that. He gave a very specific answer and then he verified it numerous times and he got caught,’ he said.
The president denied he had a ‘list’ of people he wanted to see indicted, but asserted ‘there will be others.’
He indicated that Comey was one of the worst offenders of using the Justice Department for politicalization.
‘Comey essentially is worse than a Democrat. I would say the Democrats are better than Comey,’ Trump said.
