A TOP judge who wished the 7/7 bombings mastermind “all the best” could be condemned by Parliament.
Tory Shadow Justice Secretary Robert Jenrick tabled an Early Day Motion yesterday to express “profound concern” the actions of Sir Robert Jay.
The Sun revealed this month that the judge sympathised with Al-Qaeda fiend Haroon Aswat, 50, ahead of his release.
In courtroom remarks Mr Justice Jay told Aswat – who confessed to the 2005 London atrocity and a role in 9/11 – “I have to wish you all the best”.
Mr Jenrick’s motion says that Parliament notes that the remarks are wholly inappropriate given the gravity of Aswat’s offences”.
It adds that they “falls below the high standards of judgment required of a holder of senior judicial office and risks diminishing public confidence in the administration of justice”.
As of last night 12 MPs had backed the Early Day Motion – which rarely get debated in the Common chamber but can demonstrate strength of feeling by MPs.
Mr Justice Jay’s jaw-dropping conversation was revealed after The Sun applied for a transcript of the High Court case held on April 1. Police had applied for a notification order to keep tabs on Aswat.
After legal submissions the 65-year-old judge asked Aswat: “Mr Aswat, is there anything you’d like to say? How are you feeling?”
Aswat replied: “I’m good.”
Mr Justice Jay: “OK. You feel stable on your treatment?”
Aswat: “Yes.”
Mr Justice Jay: “When you are released, you are going to go back to your family, I think?”
Aswat: “In Yorkshire, yes.”
Mr Justice Jay: “OK. And you understand what these requirements are?” Aswat: “I have read through all the paperwork, yes.”
Mr Justice Jay: “OK. You probably want to put all of this behind you now?” Aswat: “Indeed, I do.”
Mr Justice Jay added: “It could not have been too pleasant being in American custody all that time.
“I have to wish you all the best and say to you that the way forward is to keep on your medication, listen to the advice you are going to get, and keep out of the sort of things you were doing.
“Because you saw where it ended up and you do not want to go back to that, I am sure.”
